FXCM ALL ASSETS BATTLE CONTEST TERMS AND CONDITIONS

1. THE CONTEST Subject to these terms and conditions, ten (10) winners will have the opportunity to win cash prizes directly funded in their FXCM trading accounts. $2150 in total prizes will be given out. A US$1000 funding will go to 1st place, $500 for 2nd place, $300 for 3rd place and $50 for 4th to 10th place (the "Prize") through an exclusive contest, which will be conducted on FXCM's Page https://contest.fxcm.com. (the "Contest").
2. BINDING AGREEMENT You agree that by participating in the Contest you will be bound by these terms and conditions (the "Terms and Conditions").
3. HOW TO PARTICIPATE To be eligible to participate in the Contest, you must: (a) be a natural person; (b) be over eighteen years of age or over the age of maturity in your jurisdiction; (c) be an existing client or a lead; (d) be a resident from one of the following countries following countries following countries: Albania, Andorra, Angola, Anguilla, Antigua and Barbuda, Argentina, Armenia, Aruba, Azerbaijan, Bahamas, Bahrain, Bangladesh, Barbados, Belize, Benin, Bermuda, Bhutan, Bolivia, Bosnia and Herzegovina, Bonaire, Sint Eustatius and Saba, Botswana, Brazil, Brunei, Burkina Faso, Cambodia, Cameroon, Cape Verde Islands, Cayman Islands, Chad, Chile, Colombia, Comoros, Costa Rica, Curacao, Djibouti, Dominica, Dominican Republic, Ecuador, Egypt, El Salvador, Equatorial Guinea, Eritrea, Ethiopia, Falkand Islands, Faroe Islands, Fiji, Gabon, Gambia, Georgia, Ghana, Greenland, Grenada, Guatemala, Guinea, Guinea-Bissau, Guernsey, Channel Islands, Guyana, Haiti, Honduras, India, Indonesia, Iraq, Ivory Coast / Cote d'Ivoire, Jamaica, Jersey, Channel Islands, Jordan, Kazakhstan, Kiribati, Kosovo, Kuwait, Kyrgyzstan, Laos, Lebanon, Lesotho, Madagascar, Malawi, Malaysia, Maldives, Mali, Marshall Islands, Mauritania, Mauritius, Mexico, Micronesia, Moldova, Mongolia, Montenegro, Montserrat, Morocco, Mozambique, Burma (Myanmar), Namibia, Nauru, Nepal, Nicaragua, Niger, Nigeria, Oman, Pakistan, Palau, Palestinian Territory Occupied, Panama, Papua New Guinea, Paraguay, Peru, Philippines, Qatar, Republic of North Macedonia, Rwanda, Saint Kitts and Nevis, Saint Lucia, Saint Martin, Saint Vincent, Samoa, San Marino, Sao Tome And Principe, Saudi Arabia, Senegal, Serbia, Seychelles, Sierra Leone, Solomon Islands, Sri Lanka, St Helena, Sint Marteen (St Martin), Suriname, Eswatini/Swaziland, Taiwan, Tajikistan, Tanzania, Thailand, Togo, Tonga, Trinidad and Tobago, Tunisia, Turkmenistan, Turks and Caicos, Tuvalu, Uganda, United Arab Emirates, Uruguay, Uzbekistan, Venezuela, Vietnam, Yemen, Zambia; (e) Individuals who have been previously banned from FXCM are not eligible to open a live FXCM account and/ or to receive prizes as a result of winning this Contest; (f) register at https://contest.fxcm.com/ as a participant (the "Contest"); and (g) To be eligible to participate and receive a prize pursuant to the contest, the Winner must: 1. be willing to permit their username and trading record for the contest to be published and/or distributed by FXCM, its agent and successors during and after the life of the Contest; 2. if the Winner is not an existing FXCM client, in order to receive the cash prize, the winner is required to open an account with FXCM Markets Limited. The account application will undergo approval process by FXCM, whereby applicants may be required to provide valid ID and Proof of Residence. In the event that the live FXCM account is not approved, FXCM will not give out the cash prizes; and 3. agree and comply with these Terms and Conditions. (Collectively, the "Eligibility Requirements"). For the avoidance of doubt, if you do not comply with the Eligibility Requirements, you will not be entitled to participate in this Contest.
4. CONTEST PERIOD (a) For each individual contest, the start and completion time will be displayed on the FXCM registration page; (b) Registration is available any time until the end of the completion of the contest; (c) Upon registration login instructions will be sent to the participants email address; (d) Only one account per participant per contest is permitted; and (e) You must complete the online form to sign up for the Contest. Once you have completed the form, you will gain access to the Contest on FXCM's page https://contest.fxcm.com. (Collectively, the "Participation Criteria"). FXCM shall have in its sole discretion the right to disqualify any entrants, participant or winner for any reason. Participation at any time except during the contest period will be invalid.
5. WINNER SELECTION
   5.1 Subject to FXCM's rights under these Terms and Conditions, if you meet the Eligibility Requirements and the Participation Criteria, your participation will be valid.
   5.2 The ten (10) participants with the highest returns at the end of the contest period, after liquidation (the "Winners").
   5.3 If the equity of the account drops below 50% of its initial value or you receive any Margin Call you will be disqualified from the current competition and ineligible to win prizes.
   5.4 The winners are allowed to withdraw money without restrictions.
   5.5 There are ten (10) Winners of this Contest. The Winners for the Contest will be announced within fourteen (14) business days after the end of the Contest Period.
   5.6 The cash prizes will be deposited within twenty-one (21) business days after the end of the Contest Period.
   5.7 By accepting a prize, each winner agrees that they are responsible for all applicable taxes associated with such prize including but not limited to any income, profits and gains and any other tax, duty, contribution, levy or charge in the nature of tax of any nature, whether domestic or foreign, federal or state.
   5.8 FXCM shall have no further obligation to the winner once the Prize is delivered.
6. LIABILITY
   6.1 You agree to indemnify, defend and hold harmless FXCM (including its directors, officers, employees and assigns) on written demand and at all times from and against any and all liability, fines, penalties, actions, judgement, settlement, claims, demands, losses, damages, injury, compensation, costs and expenses (including interest payments, reasonable legal fees on a solicitor/client basis, other professional fees and disbursements and costs of investigation and litigation) for or in respect of which FXCM will or may become liable by reason of or related or incidental to any act, default or omission and/or any breach of representation and warranty set forth herein by you under these Terms and Conditions including without limitation resulting from or in relation to any breach, non-observance, act or omission whether negligent or otherwise.
   6.2 To the extent permitted by law, your rights to litigate, to seek injunctive relief or to any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and you expressly waive any and all such rights.
7. GENERAL CONDITIONS
   7.1 In the event that FXCM considers your participation in this Contest is, or is likely to be, in breach of these Terms and Conditions, FXCM reserves the right, without prejudice to any other rights under the Terms and Conditions, to immediately withdraw your participation from the Contest.
   7.2 FXCM may, in its discretion, cancel, or reverse the award of the Prize if it is made in error.
   7.3 FXCM reserves the right at its sole discretion to alter, amend, modify, suspend or terminate this Contest, or any aspect of it, including but not limited to extending the contest period at any time and without prior notice. In such event, FXCM will make reasonable efforts to notify you by email.
   7.4 If the Contest cannot be executed as planned, due to reasons beyond the control of FXCM, including (but not limited to) any problems or technical malfunction, FXCM shall incur no liability to you in connection with the Contest.
   7.5 All former and current employees, interns and contractors of FXCM (the "Staff"), and each of its affiliates and subsidiaries and the Staff's immediate family members and persons with whom such employees are domiciled are prohibited from participating in the Contest.
   7.6 If any provision(s) of the Terms and Conditions are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
   7.7 Unless the context otherwise requires, references to any gender include all genders and use of the singular includes the plural and vice versa.
   7.8 You are solely responsible for the payment of any and all taxes, including but not limited to federal, state and local taxes that may apply to your participation in the Contest.
   7.9 FXCM may, at its sole discretion, provide you with translations of the Terms and Conditions. The original English version shall be the only legally binding version for FXCM and you. In case of discrepancies between the original English version and other translations in your possession, the original English version shall prevail.
8. GOVERNING LAW AND VENUE These Terms and Conditions shall be governed by and construed in accordance with the laws of Bermuda. The Parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms and Conditions.
