How will the transfer affect you?

Following a successful transfer, FXCM UK will be the sole legal entity responsible for providing ongoing trading services to you for any migrated account. Margins on your account with FXCM UK will be tied to a notional value of all open contracts in your portfolio rather than the fixed amounts currently applicable to your account with FXCM AU. FXCM UK will still offer you access to the same range of products such as rolling spot foreign exchange contracts (with currency pairs identical to those available through FXCM AU) and contracts for difference (which will allow you to trade oil, gold, silver, stock indices and the US Dollar basket). In addition, FXCM UK offers spread betting to residents of the UK and Ireland.

With FXCM UK, you will have a new customer agreement. Additionally, any funds and assets that FXCM AU currently holds for you will be transferred to FXCM UK, and held by FXCM UK thereafter. Please read the new agreement carefully, as your rights and obligations may change.

The type of execution you receive upon transfer depends on your account’s equity. If it is 20,000 units of the account’s base currency or lower and provided open positions and pending orders on unavailable instruments are closed prior to the transfer you will be put onto a dealing desk execution. By submitting the this form, I authorise and direct FXCM AU to transfer my account (including but not limited to all monies, assets, open positions and personal information) to FXCM UK, subject to the following terms and conditions (the "Transfer Terms"):

  1. I have read, understood, and agree to FXCM UK's Charges and Fees which will apply to my account.
  2. I have read, understood, and agree to FXCM UK's Terms of Business (the "Agreement") and FXCM UK's relevant policies as provided in the following links: Risk Disclosure, Conflict of Interest Policy and Execution Policy (collectively the "Terms"). I acknowledge that the Terms will govern my accounts and trading activity with FXCM UK.
  3. I consent to electronic communication in accordance with the Terms. Furthermore, I agree that FXCM UK may provide me with certain information, reports and statements via its website or secure access client site (including but not limited to trade confirmation information, account statements and periodic information as defined in the FCA Handbook) rather than by means of a durable medium (as defined in the UK Financial Conduct Authority's rules ("FCA Rules") such as by paper and/or email.
  4. I agree and acknowledge that FXCM UK may execute orders on my behalf outside of a regulated market or multi-lateral trading facility (as such terms are defined in the FCA Rules).
  5. I agree and acknowledge that in the case of a limit order in shares admitted to trading on a regulated market which are not immediately executed, FXCM UK is not bound to facilitate the earliest possible execution of that order by making it public in an easily accessible manner.
  6. I agree that my financial instruments including but not limited to safe custody assets such as equities (as such terms are defined in the FCA Rules) may be registered in FXCM UK's name or in the name of its nominee, where applicable.
  7. I agree and acknowledge that FXCM UK may enter into arrangements for securities financing transactions in respect of financial instruments held by FXCM UK on my behalf (including an omnibus account held by a third party) or otherwise use such financial instruments for its own account or the account of another client, where applicable.
  8. I consider FXCM UK's offered product(s) (as relevant) as being suitable products for me.
  9. I agree that FXCM AU may, at any day and time of its choosing within twelve calendar months from the date this form is submitted (subject to FXCM AU's sole and absolute discretion), transfer all of the monies and positions then held and open with FXCM AU to a new account with FXCM UK (the "Account"), which means that the positions opened by FXCM UK will be in the same instruments, sizes, and rates as those then open with FXCM AU. I understand that FXCM AU will transfer all of the monies in my account to FXCM UK in the same currency(ies) that such monies were held in with FXCM AU. Any pending orders including stops and/or limits will be transferred to your account held with FXCM UK.
  10. I understand that the margin requirements governing my account with FXCM AU will be different to the margin requirements that will govern my Account with FXCM UK. I am aware of FXCM UK's margin requirements and I agree to keep enough usable margin on my account with FXCM AU to support the new margin requirements with FXCM UK at and following the time of transfer. I understand that FXCM UK may close all of my open positions at or near the time of transfer, or exercise any of its rights under the Terms, if I do not have enough available margin (accordance with FXCM UK's margin requirements) in my Account to support my then open positions at or near the time of transfer.
  11. I agree that following my submission of this form, FXCM AU and FXCM UK will act in a commercially reasonable manner to review and process my request for transfer, but neither shall not be bound to act nor make any decision within a specified period of time other than the twelve calendar months prescribed in clause nine above. FXCM AU and/or FXCM UK may reject my request to transfer in its/their sole and absolute discretion.
  12. I agree to indemnify FXCM AU and FXCM UK, and to hold both harmless for any errors or issues arising from the transfer, including but not limited to any losses arising out of or in relation to any decisions taken by FXCM AU and/or FXCM UK about the exact date and time of the transfer, so long as FXCM AU and FXCM UK acted within a commercially reasonable manner.
  13. I agree that upon my consent and my account being transferred successfully, my funds will no longer be held in accordance with the applicable AU Client Money regulation, and therefore my funds will be subject to the applicable client money regulations/laws for FXCM UK.
  14. I acknowledge that following the transfer, I will be classified as a Retail Client (as defined by the FCA Rules) unless I am specifically informed otherwise. Where I am classified as a Retail Client (as such term is defined in the FCA Rules), I acknowledge and agree that the UK Financial Conduct Authority's ("FCA") client money rules will apply to my Account. Where I am classified as a Professional Client or Eligible Counterparty (as such term is defined in the FCA Rules), I acknowledge and agree that the UK Financial Conduct Authority's ("FCA") client money rules will not apply to my Account.
  15. I agree that the transfer of my account from FXCM AU to FXCM UK is contingent upon executing and delivering any other documents, agreements and/or instruments that FXCM AU and/or FXCM UK may reasonably request to review or process my request.
  16. I authorise and consent to FXCM AU providing FXCM UK with any personal information related to my account with FXCM AU which may reasonably be required in order to permit FXCM UK to open and administer the Account.
  17. I understand and acknowledge that upon the transfer my account, my account will no longer be held with FXCM AU which falls under ASIC jurisdiction (AFSL Registration Number 309763) and that my account will be held with FXCM UK which is regulated by the FCA (Firm Registration Number 217689). I authorise FXCM AU to immediately terminate my relationship with it, to the extent of the transferred account, upon completion of the transfer.
  18. By submitting this form, the client or representative of the client listed above acknowledges and agrees that he/she/it is authorised to submit the request on behalf of the account listed above (whether or not such account is an individual, joint or corporate account), and that he/she/it has obtained all necessary consents to submit this form. Where this form is submitted by one account holder listed on a joint account, FXCM AU and FXCM UK may process the form as if it was submitted by all joint account holders together.
  19. These Transfer Terms shall be governed by and construed in accordance with the laws of England and Wales and the parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute which may arise out of or in connection with these Transfer Terms. Both FXCM AU and FXCM UK have full rights to benefit from my agreement to these Transfer Terms and either or both parties may enforce the provisions of these Transfer Terms against me.
  20. FXCM AU and FXCM UK will use commercially reasonable efforts to review (and if it so decides, process) your transfer request in due course.
